Montgomery County Council Updates Eviction Notice Requirements
In September 2025, our Landlord Representation team communicated that Maryland enacted a new eviction law (HB 767), which went into effect on October 1, 2025, and requires all Maryland landlords to provide tenants six days’ advance notice of a scheduled eviction. On December 15, 2025, the Montgomery County Council enacted Council Bill 31-25, which expands notice requirements for residential evictions. The new bill requires Montgomery County landlords* to:
- Provide 14 days’ advance notice to tenants scheduled for eviction and provide information and resources on eviction that includes a URL link to the County's website; and
- Email a copy of the notice to the County Department of Housing and Community Affairs at DHCA.Evictionnotice@montgomerycountymd.gov.
This emergency legislation is effective immediately. All Montgomery County landlords* must comply with the 14-day notice requirement and email submission.
